Former supervisor's appeal of conviction in teenager's workplace death dismissed

The New Brunswick Court of Appeal has dismissed the appeal of a former construction supervisor who was convicted of criminal negligence in the death of a teenager at a Fredericton jobsite.

The New Brunswick Court of Appeal has dismissed the appeal of a former construction supervisor convicted of criminal negligence in the death of a teenager at a Fredericton worksite.   

Jason King, who was a foreman with Springhill Construction Ltd., was charged after the death of 18-year-old Michael Henderson, who died under his supervision in August 2018. 

King was sentenced to three years in prison in September 2023 following a three-week trial earlier that year, but was released on bail while the Court of Appeal considered his case. 

His defence lawyer, Patrick Hurley, argued the judge erred in considering evidence during his trial and appealed the sentence. 

Thursday, the court dismissed that appeal and ordered that Kiing surrender within 24 hours to begin serving his sentence.

Henderson died in a large concrete pool-like structure, known as a clarifier, at the City of Fredericton's sewage plant on Barker Street. The hole filled with water when a pneumatic plug gave away and Henderson, who was trapped in the hole, drowned.
