Crown withdraws murder charge against 1 of 3 accused in Moncton stabbing case
2 others still face trial in death of Kyla LaPointe in 2023
A murder charge was withdrawn this week against one of three people in connection with a fatal Moncton stabbing.
Dana Livingston Mundell of Fredericton had faced a charge of second-degree murder. He was accused of killing 32-year-old Kyla LaPointe in Moncton on July 11, 2023.
A Crown prosecutor withdrew the charge during an appearance in Moncton's Court of King's Bench on Wednesday.
"After several months of deliberation, the Crown came to its conclusion that a reasonable prospect of conviction against Mr. Mundell was no longer evident from the evidence required to convict him," T.J. Burke, Mundell's defence lawyer, said in a statement to Radio-Canada.
"Mr. Mundell is satisfied with this outcome and wishes to move forward with his life by placing this entire matter behind him."
Mundell had been held in remand pending trial since his arrest 15 months ago.
Dylan Alexander Jackson of Doaktown and Megan Marten of Fredericton still face second-degree murder charges in the case. They are set to be tried by a jury from March 24 to April 11, 2025.
RCMP said last year that police responded to a report of a disturbance on Belleview Avenue at around 2:45 a.m. on July 11, 2023. Officers found LaPointe with multiple stab wounds. She died in hospital.
