B.C.'s Criminal Justice Branch has recommended charges not be laid against four RCMP officers involved in a shooting near Valemount, B.C. that left a 51-year-old man dead.

The Crown says the evidence gathered by the Independent Investigations Office — which investigates all police-involved shootings — does not meet standards for charge approval.

John Buehler died after Emergency Response Team officers fired several shots in an attempt to arrest him for failing to appear in court on previous charges.

His adult daughter, Shanna Buehler, was also shot, and has since recovered.

Soon after the September 2014 incident, the RCMP claimed its officers were shot at, and returned fire in an exchange of gunfire.

A probe later by the Independent Investigations Office found no evidence both parties fired shots.

A statement from the provincial Crown said the Buehlers were armed at the time of the shooting, but few details were provided as the Crown goes on to say at least one matter arising from the case is currently before the court.

Earlier police confrontation

Buehler had been arrested and charged in a separate incident earlier in 2014.

That arrest followed an extended standoff with police.

Buehler was allegedly found in possession of numerous unlicensed firearms and thousands of rounds of ammunition.
